Terms of Service
The basic rules that apply when using CreatorGuard services.

1. Acceptance of these terms
By purchasing, requesting, or using a CreatorGuard service, you agree to these Terms of Service, the Refund Policy, the Service Guidelines, and any service-specific scope confirmed in your ticket. If you do not agree, do not use the service.
2. What CreatorGuard provides
CreatorGuard provides creator-focused support services such as evidence organization, project documentation, ownership record organization, dispute support, DMCA preparation assistance, copyright registration assistance, commission safety setup, and related creator support.
CreatorGuard may help prepare information, organize materials, explain process steps, or assist with submissions when that is included in the agreed service. CreatorGuard does not control Roblox, Discord, PayPal, Stripe, banks, payment processors, government offices, courts, or other third parties.
3. Independent legal review
Where appropriate, CreatorGuard may arrange for certain agreements, documents, notices, or other materials to be reviewed by an independent lawyer or law firm that is licensed to provide legal services in the applicable jurisdiction. CreatorGuard itself is not a law firm and does not provide legal advice, legal opinions, or legal representation.
Any legal advice, legal opinion, or professional legal review is provided by the independent lawyer or law firm, not by CreatorGuard. A lawyer-client relationship exists only if and when the independent legal professional agrees to establish one with the client. CreatorGuard does not guarantee that a lawyer or law firm will accept a matter.
If client information or documents must be shared for an approved legal review, CreatorGuard may request the client's authorization before sending those materials. Separate lawyer, law-firm, filing, or professional fees may apply and will be identified where applicable. CreatorGuard does not receive or promise unauthorized referral fees for directing a client to a legal professional.
4. No guaranteed outcome
CreatorGuard cannot guarantee that a platform will remove content, that another person will respond, that a payment dispute or chargeback will succeed, that money will be recovered, or that a copyright filing will be accepted or processed within a particular time. Third parties make their own decisions under their own rules.
5. Your responsibilities
You are responsible for providing accurate and complete information. You must only submit files, evidence, statements, or materials that you are authorized to use or share.
- Do not knowingly submit false, altered, misleading, or fabricated evidence.
- Do not ask CreatorGuard to impersonate another person or misrepresent facts.
- Do not submit passwords, login codes, authentication tokens, recovery codes, or unnecessary banking credentials.
- Tell staff if important facts change while a case is active.
- Review prepared materials for factual accuracy before they are submitted or used.
6. Service scope
The scope of a service is based on what is confirmed in the ticket, including the service type, price, expected deliverables, and any agreed limits. Work outside the agreed scope may require a new quote or additional service.
Reasonable corrections may be provided when a deliverable does not match the agreed scope. New requests, major changes, or additional work are not automatically included as revisions.
7. Payments and third-party fees
Payment may be required before work begins. CreatorGuard will identify the service price before paid work starts whenever practical. Government filing fees, platform fees, processor fees, taxes, currency conversion, and other third-party charges may be separate unless specifically stated otherwise.
Do not send payment through an unofficial method or to a person who has not been authorized by CreatorGuard.
8. Copyright and filing assistance
When CreatorGuard assists with copyright registration or DMCA-related requests, you remain responsible for the truth and accuracy of the information provided. CreatorGuard may format or organize information and may assist with submission when authorized, but you remain the person responsible for the underlying claims and facts.
9. Client materials and CreatorGuard materials
You retain ownership of materials that you submit, subject to any rights owned by others. You give CreatorGuard permission to access, copy, organize, format, and use submitted materials only as reasonably necessary to provide the requested service, maintain service records, prevent abuse, or handle a dispute.
CreatorGuard retains ownership of its internal processes, templates, branding, software, and general service materials unless a service specifically transfers rights to a client deliverable.
10. Privacy and records
CreatorGuard handles client information according to the Privacy & Data Requests page. Some records may be retained when reasonably necessary for payment records, security, fraud prevention, abuse prevention, dispute handling, or other legitimate business purposes.
11. Conduct and refusal of service
CreatorGuard may pause, limit, or refuse service when a user is abusive, threatening, deceptive, repeatedly disruptive, attempting fraud, requesting prohibited activity, or creating unreasonable risk for staff or other users. CreatorGuard may also refuse a request that is outside its service capability or scope.
12. Service availability
Response times and completion times are estimates unless a specific deadline is expressly agreed in writing. Maintenance, staff availability, missing client information, third-party delays, and complex requests may affect timing.
13. Limitation of liability
To the maximum extent permitted by applicable law, CreatorGuard is not liable for indirect, incidental, special, exemplary, punitive, or consequential losses, including lost profits, lost opportunities, loss of data, loss of reputation, or losses caused by third-party decisions, platform enforcement, government processing times, payment processor decisions, inaccurate client information, lost account access, or actions taken outside the agreed CreatorGuard service.
To the maximum extent permitted by law, CreatorGuard's total aggregate liability arising from or relating to a specific paid service will not exceed the amount actually paid to CreatorGuard for that specific service. If the service was provided without charge, CreatorGuard's liability will be limited to the minimum amount, if any, required by applicable law.
These limitations apply to CreatorGuard and, to the maximum extent permitted by law, its owners, staff, contractors, volunteers, and agents when acting within the scope of CreatorGuard services. Nothing in these Terms excludes or limits liability, rights, remedies, or statutory protections that cannot legally be excluded or limited.
14. Dispute notice and opportunity to resolve
Before beginning formal legal proceedings against CreatorGuard, a user agrees, where legally permitted, to first send a written notice describing the dispute to escalations@creatorproof.ca and provide CreatorGuard a reasonable opportunity to review and attempt to resolve the matter. A reasonable review period will normally be up to 30 days after CreatorGuard receives enough information to understand the dispute.
This process is intended to encourage an early resolution and does not prevent a user from seeking urgent relief or exercising any consumer, court, class proceeding, limitation-period, or other right that cannot lawfully be waived or restricted.
15. Governing law and forum
To the maximum extent permitted by applicable law, these Terms and disputes relating to CreatorGuard services are governed by the laws of Ontario and the applicable federal laws of Canada. Where the parties are legally permitted to choose a forum, they agree that proceedings will be brought in a court of competent jurisdiction in Ontario, Canada. This clause does not override any mandatory jurisdiction or consumer-protection right that applies to a user.
16. Changes to services or terms
CreatorGuard may update these terms as services change. Material updates will apply from the stated effective date. Active paid work will generally continue under the service scope that was agreed when the order started unless both sides agree to a change.
